Why Should I File Bankruptcy?

Posted by admin March - 20 - 2011 - Sunday ADD COMMENTS

Our clients file bankruptcy for many reasons. An accident or medical illness without insurance has left unpaid medical bills. Divorce has left them with more bills than they can pay on their own. The loss of a job or layoff has caused financial stress. Some clients file because they are overwhelmed with the collection calls and want them to STOP!

WHY SHOULD I USE PODIS AND PODIS?
The Bankruptcy process has several steps. First, you need a pre-bankruptcy credit counseling certificate. We walk you through that process. Second, the completion and signing of the Bankruptcy Petition. Third, your court date called the Meeting of Creditors. Mark or Cynthia Podis attend all court dates with you. We also explain the process to you and what questions to expect in court.
Fourth, the Post-Petition Financial Management Certificate is required for Discharge in both Chapter 7 and Chapter 13. In Chapter 7, we register you for the class and file your certificate. We provide computer time for you to take the class in our office if you do not have access to the internet. In Chapter 13 Bankruptcy, the Trustee provides a class you can take at no additional charge by calling 244-1101 or register online at www.ch13nsh.com.
Next is the Discharge in Chapter 7. This Order cannot be filed until at least 60 days after the Meeting of Creditors.
In Chapter 13, the Discharge Order will not be entered until after all payments have been made, the case has been audited by the Trustee, and the Domestic Obligation Certificate has been filed with the Court.
